Liability Release, Hold Harmless,

& Indemnification Agreement

I hereby certify that I am over eighteen (18) years of age, and I am of sound mind at the time of the execution of this Waiver, Release, Hold Harmless, and Indemnification Agreement (hereinafter “Release”) and agree to the terms set forth below.

Cafe Zoomies (Zoomies Cafe LLC) provides dog-related activities, including allowing participants to bring their own dogs to its premises and other locations. In consideration of allowing me and my dog to participate in these activities, including interacting with other dogs, I agree to be bound by the terms of this waiver and release set forth herein.

I am aware of, and fully understand, the inherent dangers involved in interacting with dogs, including the risk of damage, personal injury, and death to myself, my dog, other persons, other dogs, my property, and/or the property of others. I acknowledge that participating in activities with dogs potentially exposes me and my dog to illness from infectious diseases and the risk of serious illness and death from such diseases, including but not limited to zoonotic diseases. I knowingly and freely assume all such risks, injury, harm, and loss related to the dog-related activities, even if arising from the negligence or fault of Cafe Zoomies or its staff.

I certify that my dog is in good health, is free from any contagious illnesses or parasites, and is up-to-date on all vaccinations required by Cafe Zoomies, including rabies and core vaccinations. I understand that proof of vaccination may be requested at any time.

I knowingly, freely, and voluntarily execute this Release with such knowledge and assume full and sole responsibility for the risk of damage, death, personal injury, and/or property loss arising from or in any way connected with my participation, or my dog’s participation, in the activities provided by Cafe Zoomies, including any injury, harm, and loss caused by the negligence, fault, or conduct of any kind on the part of Cafe Zoomies.

I further acknowledge that participants in such activities, including their dogs, other clients, staff, and other individuals involved, may not be covered under Cafe Zoomies insurance, and I may not have any right to file a claim against Cafe Zoomie's insurance policy.

I agree to abide by all rules and regulations that Cafe Zoomies may impose on me and my dog regarding participation in the activities. I agree to undertake all activities in a responsible manner. If I am unwilling or unable to follow any rules, Cafe Zoomies may terminate my and/or my dog’s participation in the activities and expel us from the premises without any refund of fees.

I acknowledge that interacting with the dogs may not be continuously supervised, and Cafe Zoomies staff may not be present for the entire duration of my participation or my dog’s participation. Staff will remain available to offer guidance, monitor activity, and assist in the event of any difficulties.

I have no physical or emotional issues, including but not limited to any allergies, which would adversely affect my ability to interact with the dogs in a safe and appropriate manner. I also certify that my dog is in good health, has no known aggressive tendencies, and is up-to-date on all vaccinations required by Cafe Zoomies.

I agree not to engage in any activity that will injure or otherwise harm the dogs, including my own dog, in any manner.

I hereby release and forever discharge Cafe Zoomies, its staff, volunteers, and associated parties (collectively "Indemnified Parties"), from any liability, claim, cause of action, demand, and damages for injury, death, or damages of any kind or nature whatsoever to myself, my dog, or my property as a result of my or my dog’s engaging in any activities with Cafe Zoomies, whether such injury, death, or property damage is caused by the intentional or negligent act or omission on the part of (i) any other participant, (ii) any employee or volunteer of Cafe Zoomies, or (iii) any other person or dog at Cafe Zoomies. Furthermore, I agree to pay any and all attorneys’ fees and costs incurred by Cafe Zoomies if I bring any action, claim, or demand against Cafe Zoomies or any of its affiliates for any reason for which this Release applies.

I agree to defend with counsel chosen by the Indemnified Parties, indemnify, and hold harmless Cafe Zoomies, its staff, volunteers, and associated parties from any liability, claim, cause of action, demand, or damages for injury, death, or damages of any kind or nature whatsoever to any person, their dog, or their property resulting from any actual or claimed intentional or wrongful act or omission by me or my dog arising from or as a result of our presence at Cafe Zoomies or our participation in any activities at Zoomies. I agree to provide said defense and indemnity regardless of the merit of the claim.

I agree to and hereby bind my heirs, executors, assigns, and all other legal representatives by executing this Release.

I acknowledge and agree that this Release is intended to be construed and interpreted as broadly and inclusively as permitted by the laws of the State of California. If any portion of this Release is found or declared to be invalid or unenforceable, such invalidity shall not affect the remainder of this Release, and the remainder shall remain in full force and effect. This Agreement shall be governed by the laws of the State of California, as to all matters, including but not limited to matters of jurisdiction, validity, property rights, construction, effect, and performance. All disputes shall be subject to litigation only within the courts of the State of California, and I hereby submit to the jurisdiction of the aforementioned court.

BY EXECUTING THIS RELEASE, I ACKNOWLEDGE THAT I HAVE READ THIS RELEASE, UNDERSTAND THE CONTENTS HEREOF, HAVE BEEN ADVISED AND HAD THE OPPORTUNITY TO SEEK INDEPENDENT COUNSEL OF MY CHOICE, AND CERTIFY THAT I HAVE FREELY AND VOLUNTARILY EXECUTED THIS RELEASE. I ACKNOWLEDGE THAT, BUT FOR THE EXECUTION OF THIS RELEASE AND AGREEING TO BE BOUND BY THE TERMS HEREOF, CAFE ZOOMIES WOULD NOT AUTHORIZE ME OR MY DOG TO PARTICIPATE IN ANY ACTIVITIES WITH CAFE ZOOMIES.
